Group Hospitalisation & Surgical Coverage

Policy Exclusions
1) Pre-Existing Illness shall mean :-

Disabilities that existed before the Effective date of Insurance that the Insured Person has reasonable knowledge of. An Insured Person may be considered to have reasonable knowledge of a pre-existing condition where the condition is one for which :-

a) the Insured Person had received or is receiving treatment;
b) medical advice, diagnosis, care or treatment has been recommended;
c) clear and distinct symptoms are or were evident; or
d) its existence would have been apparent to a reasonable person in the circumstances.

2) SPECIFIED ILLNESSES shall mean the following disabilities and its related complications occurring within the first 120 days of Insurance of the Insured Person :-

i) Hypertension, diabetes mellitus and Cardiovascular Disease
ii) All tumours, cancers, cysts, nodules, polyps, stones of any kind
iii) All ear, nose (including sinuses) and throat conditions
iv) Hernias, haemorrhoids, fistulae, hydrocele, varicocele
v) Endometriosis including disease of the female Reproduction System
vi) Vertebro-spinal disorders (including disc) and knee conditions

WAITING PERIOD
Eligibility for benefits starts 30 days after the Insured has been included in the Policy, except for a covered Accident occurring after the effective date of coverage.

Exclusions
This Policy shall not cover: -
1. Pre-existing illness.

2. Specified Illnesses occurring during the first 120 days of continuous cover.

3. Any medical or physical conditions arising within the first 30 days of the Insured Person’s cover or date reinstatement whichever is latest except for accidental injuries.

4. Care/treatment for which payment is not required or to the extent which is payable by any other insurance/indemnity covering the Insured and disabilities arising out of duties of employment or profession that is covered under a Workman’s Compensation Ins Contract.

5. Plastic/Cosmetic surgery, circumcision, eye examination, glasses and refraction or surgical correction of nearsightedness (Radial Keratotomy or Lasik) and the use or acquisition of external prosthetic appliances or devices such as artificial limbs, hearing aids, implanted pacemakers and prescription thereof.

6. Dental conditions including dental treatment or oral surgery except as necessitated by Accidental Injuries to sound natural teeth occurring wholly during the Period of Insurance.

7. Private nursing, rest cures or sanitaria care, illegal drugs, intoxication, sterilization, venereal disease and its sequelae, AIDS or ARC and HIV related diseases, any communicable diseases required quarantine by law.

8. Any treatment or surgical operation for congenital abnormalities / deformities including hereditary conditions.

9. Pregnancy, child birth (including surgical delivery), miscarriage, abortion and prenatal or postnatal care and surgical, mechanical or chemical contraceptive methods of birth control or treatment pertaining to infertility. Erectile dysfunction and tests or treatment related to impotence or sterilization.

10. Psychotic , mental and nervous disorders (including any neuroses and their physiological or psychosomatic manifestations).

11. Hospitalization primarily for investigatory purposes, diagnosis, x-ray examination, general physical or medical examinations not incidental to treatment or diagnosis of a Covered Disability or any treatment which is not Medically Necessary and any preventive treatments, preventive medicines or examinations carried out by a Physician, and treatments specifically for weight reduction or gain.

12. Costs/expenses of services of a non-medical nature such as television, telephones, telex services, radios or similar facilities, admission kit/pack and other ineligible non-medical items.

13. Sickness or injury arising from racing of any kind (except foot racing), hazardous sports such as but not limited to skydiving, water-skiing, underwater activities requiring breathing apparatus, winter sports, professional sports and illegal activities.

14. Suicide, attempted suicide or intentionally self-inflicted injury while sane or insane.

15. Private flying other than as a fare-paying passenger in any commercial scheduled airlines licensed to carry passengers over established routes.

16. War or act of war, declared or undeclared, criminal or terrorist activities, active duty in any armed forces, direct participation in strikes, riots and civil commotion or insurrection.

17. Ionising radiation or contamination by radioactivity from any nuclear fuel or nuclear waste from process of nuclear fussion or from any nuclear weapons material.

18. Expenses incurred for donation of any body organ by an Insured Person and costs of acquisition of the organ including all costs incurred by the donor during organ transplant and its complications.

19. Expenses incurred for sex changes.

20. Investigation and treatment of sleep and snoring disorders, and hormone replacement therapy and alternative therapy such as treatment, medical service or supplies, including but not limited to chiropractic services, acupuncture, acupressure, reflexology, bonesetting, herbalist treatment, massage or aroma therapy or other alternative treatment.

Claims Procedures

Notification of Loss

In the event of claims, you are to give notification in writing within 30 days of a Disability and to provide the policy number and the name of the insured/claimant.

Documentation to be provided to expedite the claim process:-

4. Any other relevant documents

Employer's Liability

Employers may purchase this insurance which indemnify them against their legal liability at law to pay compensation and claimant's costs and expenses in respect of bodily injury by accident or disease sustained by the insured employees in the course of employment with them. The coverage also includes all costs and expenses incurred with the consent of the Company. Employees to be covered include local employees who are not eligible for contribution to the SOCSO scheme.

Workmen's Compensation Insurance

Employers may purchase this insurance to cover all their workers falling within the definition of "workman" in the Workmen's Compensation Act 1952 against personal injury by accident or disease arising out of and in the course of their employment with them. In addition, this policy also indemnify the Employers being sued by their workers for negligence.
Note:
a) "Workman" is defined as any person who has, either before or after the commencement of this Act, entered into or works under a contract of service or of apprenticeship with the employer, whether by way of manual labour or otherwise, whether the contract is expressed or implied or is oral or in writing, whether the remuneration is calculated by time or by work done and whether by the day, week, month or any longer period.

b) It is mandatory under Section 26(2) of the Workmen's Compensation Act 1952 that employers must insure all their foreign workers under the approved insurance scheme known as "Foreign Workers Compensation Scheme".

Professional Indemnity Insurance

This insurance provides indemnity to professionals e.g. engineer, lawyer, surveyor etc. for bodily injury and material damage arising from a negligent act, negligent error or negligent omission committed, or omitted or alleged to have been committed or omitted (as the case may be) by the Insured in the ordinary course of the performance of their professional services.

Product Liability Insurance

This insurance is designed to cover the legal liability of the Insured against bodily injury and property damage to users of the insured products arising out of anything harmful or defective in the insured products (or the container thereof) which are sold or supplied by the Insured. The coverage includes expenses of litigation recoverable by claimant against the Insured or incurred with the consent of the Company.

Glass Insurance

This insurance covers accidental breakage of glass in the insured premises.

Note:

a) Sum Insured can be arranged on First Loss basis, if required

Fidelity Guarantee Insurance

The Company will reimburse the Employer for all direct pecuniary loss sustained by the Insured arising out of any act of fraud or dishonesty committed by the employees as insured under the policy:

a) during the Period of Insurance;
b) during the uninterrupted continuance of employment of such employee;
c) in connection with the occupation and duties of such employee and
d) discovered during the aforesaid Period of Insurance or within 6 months thereafter or within 6 months after the death, dismissal or retirement of such employee whichever shall happen first.

Burglary Insurance

This insurance is designed to cover loss or damage to property contained in the trade premises against theft consequent upon actual forcible and violent entry upon the insured premises or committed by any person or persons (other than employees) feloniously concealed thereon.The policy also cover damage to the insured property or to the premises falling to be borne by the Insured due to such theft or any attempt thereat.

Note:
a) The insured premises shall not include any yard, garden, outbuilding or other appurtenances unless specifically stated in the schedule.

b) Sum Insured can be arranged on First Loss basis, if required.

Money Insurance

This insurance is designed to cover business establishments against loss of money whilst kept within the insured premises and/or in transit.

The policy may be extended to cover unnamed employees of the Insured against death and permanent disablement caused by assailant in an attempt to rob whilst carrying the money on behalf of the Insured.

Money means coin bank and currency notes cheques money orders postal orders current unused stamps revenue stamps and bills of exchange all belonging to the Insured or for which the Insured has accepted liability.

Equipment Insurance

This insurance is specially designed to cover against loss or damage to mobile equipment such as excavator, tractor etc. used beyond the Insured's premises e.g. at contract sites. Provided always that the said equipment is not licensed for road use and for which a certificate of Motor Insurance is not required.

The standard policy covers the insured equipment and its standard accessories and parts whilst thereon by -

a) accidental collision or overturning or collision or overturning consequent upon mechanical breakdown or consequent upon wear and tear;
b) fire external explosion self-ignition or lightning;
c) burglary housebreaking or theft.

In addition, if the equipment is disabled by reason of loss or damage insured under the policy, the Company will bear the cost of not exceeding RM500.00 reasonably incurred for its protection and removed to the nearest repairers and for its delivery within the country where the loss or damage was sustained

All Risks Insurance

This is a comprehensive insurance protection for your office equipment, plant and machinery including portable items such as cameras, laptops against the risk of fire, theft or any other accident or misfortune subject to the terms, exceptions and conditions of the policy.

Commercial Motor Insurance

Motor Insurance is a contract purchased by the owner of a vehicle from an authorised insurer to protect the policyholder (owner of the vehicle) against loss or damage to his vehicle and or against loss or damage which the policyholder might cause to another person's vehicle or property and or death or bodily injury to a third party.

Vehicle Classification

Commercial Vehicle - Goods Carrying Vehicle ('C' permit)

• Use in connection with the Policyholder's business.
• Use for the carriage of passengers (other than for hire or reward) in connection with the Policyholder's business.
• Use for social domestic and pleasure purposes.

Does not covered:-
• Use for hire or reward.
• Use for racing pace-making reliability trial or speed testing.
• Use whilst drawing a trailer except the towing of any one disabled mechanically propelled vehicle.

Type of Covers

Comprehensive
The cover offers protection against financial loss because it covers fire, theft and accidental damage to the Insured's vehicle in addition to the protection against the legal liabilities to third party for death and bodily injury and damage to property that may arise through the negligence of the driver.

Third Party
The cover offers protection against financial loss as a result of damage the driver of the vehicle may cause to the property of a third party. It also provides protection against any claims that may arise because of the death of or injury to another person through the negligence of the driver.

Goods In Transit Insurance

This insurance provides coverage for goods being transported over land only from one place to another. The scope of coverage is restricted to Fire, Theft or Accidental Means and subject to Express Exclusions of the Policy.

Cover commences from the time goods leave the place of warehouse continues during the ordinary course of transit and terminates upon delivery at destination. Temporary storage during ordinary course of transit and the process of loading and unloading are also covered.

Notes on Policy arrangement

There are three methods of issuing a Good In Transit Policy :

1. A voyage policy may be issued for a single transit. Premium is charged for the insured transit and cover terminates upon delivery at destination.

2. A time policy may be issued specifying the limit anyone transit/conveyance. Provisional premium is charged at inception based on rate applied to total estimated carryings. This provisional premium will be adjusted at end of period of insurance at rate on actual total carryings as declared by Insured. The Insurers maximum liability would be the actual loss or specified limit anyone carrying on the policy.

3. A policy may be issued based on Limit of Liability representing the total/aggregate value of transits during the period of insurance. After a claim, the Limit of Liability is diminished by the amount of claim made until the total Limit of Liability is exhausted.. The Insured may choose to include a reinstatement of loss clause to maintain for the full Limit of Liability after a loss. The Insured shall be liable to pay an additional premium at the rate of the policy calculated on the amount of loss on a pro-rata basis from the date of such loss to the expiry of the current period of insurance.

Marine Cargo Insurance

This insurance covers the risks of loss, damage, expenses and liability to goods insured during transportation from one place to another, anywhere in the world. Coverage is usually effected on a "per voyage" basis i.e. from the time the goods leave the premises of the seller till the time they finally arrive at the buyer's premises. There is no period specified in the policy. Coverage can either be effected by the buyer or the seller depending on the Contract of Sales.

The process of transportation includes air freight, ocean freight and overland carriage. The marine cargo insurance is to indemnify the cargo owner and or the financiers such as banks against financial loss arising as a result of physical loss, damage, expenses incurred or liability from the transportation process.

Loss can arise from the perils of the sea such as rough weather, sinking, stranding and collision of the ocean vessel and from fire explosion. Loss can also arise from mishandling, theft, pilferage, non-delivery at the ports or as a result of overturning, collision of and or theft from overland transports.

The insurance policy form and coverage are based on the internationally accepted London wordings. For general cargo by sea, three sets of clauses are available known as the Institute Cargo Clauses 'A' 'B' and 'C', descending in scope of cover and a brief summary is below:-

Group Personal Accident Insurance

Group Personal Accident cover a group of persons in one policy e.g. employer on the lives of employees. Our policy provides payment of benefits for bodily injury caused directly and solely by accidental means.

Loss of Profit following Machinery Breakdown Insurance

Damage to machinery will cause interference to the production. In cases where critical machineries are affected, the factory can suffer severe stoppages. This will result in loss of earnings whilst standing charges continue to be incurred. This form of insurance provides cover against loss of gross profit following indemnifiable damage to machinery. In the majority of cases, the loss of gross profit out of damage to machinery far exceeds the cost of repair or replacement.

Cover

The policy covers loss of Gross Profit following an indemnifiable accident (the cover usually follows that of the machinery breakdown policy) and is measured on the reduction in turnover compared to the same period in the last twelve months and applying the Rate of Gross Profit. Cover also extends to include Additional Expenditure reasonably incurred to minimise the loss of Gross Profit. The costs of non productive wages can be included either as treating them as a standing charge, or taking out more specific covers such as Dual Wages. Professional accountants' charges to produce certified details for the Insured's presentation of a claim can be included.

Major Exclusions

a. Loss or damage due to fire and extraneous perils.

b. Loss or damage due to the imposition of abnormal conditions directly or indirectly from testing, intentional overloading or experiments.

c. Loss or damage for which a supplier, contractor or repairer is responsible either by law or under contract.

d. Loss or damage caused by any faults or defects existing at the time of commencement of this policy with in the knowledge of the Insured or his representatives, whether such faults or defects were known to the Insurers or not.

Machinery Breakdown Insurance

All plants and machineries are susceptible to breakdowns or extraneous damages regardless of the care taken during operation or the standard of maintenance. Breakdown or extraneous damage can result from defective material or design of machinery, bad workmanship, carelessness, short circuit or other fortuitous causes. These damages are costly to repair and in exceptional cases, a major breakdown may result in a total loss. For some high technology or heavy machinery of high value, the potential loss can amount to millions of ringgit.

Cover

This form of cover protects against unforeseen and sudden physical loss or damage to machineries from cause such as defects in casting and materials, faulty design, faults at workshop or in erection, bad workmanship, lack of skill, carelessness, shortage of water in boiler, physical explosion, tearing apart on account of centrifugal force, short circuit or from any other cause not specifically excluded from the policy. The cover is operative whilst the machineries are working, or at rest, or being dismantled for cleaning or overhauling. Machineries will only be insured after successful completion of their performance acceptance test.

Machineries Commonly Insured under Machinery Insurance
This form of cover is suitable for machinery that have moving parts or which stores or transmits large amount of energy. The following are examples of such machineries:- working.

1. Boilers, heat exchangers, condensers

2. Pumps and compressors

3. AC and DC motors

4. Diesel and petrol engines

5. Steam and gas turbines

6. Alternators, motor generators

7. Switchgears, transformers, capacitors

8. Overhead cranes, lifts, escalators

9. Process equipment such as paper mill, plastic extruder, cement mil, screw press, agitated tank, etc

Major Exclusions

a. Damage due to fire and extraneous perils. These perils are more appropriately covered under Fire policy.

b. Damage to exchangeable tools, machinery parts which suffer a high rate of wear and tear or damage as a direct consequence of the continual influence of operation. These losses are in the nature of trade risks and maintenance cost, associated with the proper operation and care of machineries and should be borne by the Insured.

c. Loss or damage for which a supplier, contractor or repairer is responsible either by law or under contract.

d. Consequential loss or liability of any kind

Electronic Equipment Insurance

This class of insurance is specially designed to cover the computer systems and is divided into 3 main sections namely Section I (Material Damage), Section II (External Data Media) and Section III (Increased Cost of Working).

Cover

Section I (Material Damage)
The Insurer will indemnify the Insured against any unforeseen and sudden physical loss or damage to the interest insured from any cause, other than those specifically excluded from the policy.

Section II (External Data Media)
The Insurer will indemnify the Insured if the external data media entered in the Schedule inclusive of information stored thereon shall suffer any material damage covered by Section I, the cost of restoring the Insured external data media by replacing lost or damaged data media by new material and reproducing lost information.
Subject to special exclusions to Section II.

Section III (Increased Cost of Working)
The Insurer will indemnify the Insured for any additional expenditure incurred for the use of substitute EDP equipment not covered under this policy up to an amount not exceeding the agreed sum insured entered in the Schedule provided cause of damage/lost is indemnifiable by Section I of the policy.

Contractor's All Risk Insurance

Buildings, Plant and Machinery have to be erected/installed before commercial production could take place. During the construction/installation period, insurance protection is needed until the buildings/ plant and machinery are finally handed over to the Principal by the contractor.

Cover

Section I - Material Damage

This section of the insurance covers the contract works (Buildings, Plant and Machinery) of the Insured against any unforeseen and sudden physical loss or damage from any cause e.g. fire, lightning, collapse, collision, impact, malicious damage, theft/ burglary, flood, windstorm and most form of accidental damage unless specifically excluded.

• Section II - Third Party Liability
This section of the insurance covers the liability of the Insured against any liability in respect of third party bodily injury or property damage arising out and in the course of the construction works.

In case of plant and machinery, the policy can be extended to cover testing and expires after the first test operation or test loading is completed, or after taking over or expiry date of the policy whichever shall be earlier

Duration Of Cover

The cover commences directly upon commencement of work or after the unloading of the property insured at the contract site and expires for parts of the insured contract works taken over or put into service or expiry date of the policy whichever shall be earlier

Major Exclusion (Section I & II)

a. The deductible stated in the Schedule to be borne by the Insured in any one occurrence

b. Consequential loss of any king or description whatsoever including penalties, losses due to delay, lack of performance, loss of contract

c. Loss or damage due to faulty design

d. The cost of replacement, repair or rectification of defective material and/or workmanship, but this exclusion shall be limited to the items immediately affected and shall not be deemed to excluded loss of road damage to correctly executed items resulting from an accident due to such defective material and/or workmanship

e. Wear and tear, corrosion, oxidation, deterioration due to lack of use and normal atmospheric conditions

f. Mechanical and/or electrical breakdown or derangement of construction plant, equipment and construction machinery

g. Loss of or damage to vehicles licensed for general road use or water borne vessels or aircraft

h. Loss of or damage to files, drawings, accounts, bills, currency, stamps, deeds, evidences of debt, notes, securities, cheques

i. Loss or damage discovered only at the time of taking inventory

j. Any accidents caused by vehicles licensed for general road use or by waterborne vessel or aircraft

k. Any agreement by the Insured to pay any sum by way of indemnity or otherwise unless such liability would have attached also in the absence of such agreement

l. Others

Interest Insured

a. Section I - Material Damage
Contract works which consists of the full value of the contract works (Buildings, Plant & Machinery) at the completion of the construction/ installation. This valuation would include freight, customs dues and construction costs. It is common practice for the principal to supply the contractor with material on "free issue" to be built into the contract works. The value of such materials would not be reflected in the contract price and so the sum insured should be appropriately increased.

b. Section II - Third Party Liability
Liability to third party bodily injury or property damage claim.

Special Points

a. Constructional plant and equipment such as site offices, site power generating equipment, scaffolding, air compressors, welding equipment, concrete silos and mixers may be included, in a separate sum insured representing the new replacement value of such equipment.

b. Construction Machinery. Defined as all "plant and machinery" which renders its service only when moving and under control of an operator e.g. cranes, bulldozers, excavators, graders, loaders, pile driving & pile extracting units, trucks/lorries, site railways, concrete pumping plant. When on site, construction machinery may be insured under the policy. In such cases a complete list of these items showing the new replacement values is to be appended to the policy.

c. Debris clearance. The cost of debris removal following an accident is part of the claim under the policy to the extent that it is necessary before repairs may be put in hand. General debris removal costs for site clearance may be insured as a separate item under the policy.

d. Expediting. The insurance may be extended for additional premium to cover the extra cost of overtime rates of wages, express delivery, air freight, etc. in connection with repairs or replacements indemnifiable under the policy.

e. Insured's surrounding property. When the insurance includes the interest of the purchaser and involves extensions to or work adjoining existing premises, there is a risk of such premises and their contents being damaged as a result of accidents arising out of the construction operations.

f. Temporary works. Works constructed by the Insured on site to facilitate construction of the permanent contract works including coffer dams, shuttering, temporary diversions of waterways, etc. are exposed to the same hazards as the contract works. These temporary works may also be insured and the sum insured should be suitably increased to include their value.

g. Third Party liability. Where the contract wording stipulates that the insurance is to be for joint interests (principal, contractor and subcontractors) the third party insurance is granted to each party separately. This allows one insured party to take action against another and seek indemnity under the policy. However, persons occupied on the construction site are not covered under the policy against accidents at work if they are or could have been insured under Workmen's Compensation and/or Employer's Liability insurance.

h. Maintenance. Section I of the policy can be extended to cover, to a certain extent, loss of or damage to the construction/erection works occurring during this period.
